His sandwich took too long to come: the Seine-Saint-Denis Assize Court on Friday sentenced a 36-year-old repeat offender to 25 years in prison for the murder in 2019 of a kebab server

At the start of the evening, the Assize Court of Seine-Saint-Denis found El Hadji Bamba guilty of the murder of Mohamed Fares Ben Yahiaten, a Tunisian who arrived in France a year and a half earlier, in August 2019 in a snack restaurant in Noisy-le-Grand. She combined her prison sentence with a two-thirds security period. The murderer also received an obligation of care and a ban on carrying weapons for a period of fifteen years.

Earlier in the day, the prosecution had requested 30 years in prison during an indictment that the accused listened to with his head buried in his knees.

“You have to deliver justice in this case and your role is to protect society […] There is no room for leniency in this case, ”said the general counsel to the court which had been judging El Hadji Bamba since Tuesday.

On August 16, 2019, the accused entered the heavily alcoholic snack restaurant Le Mistral and ordered a sandwich. As the wait drags on, he gets angry with the waiters, becomes threatening. Mohamed Fares Ben Yahiaten, a waiter in charge of preparing the pizzas that day, tries to calm him down and offers him a pizza instead of a sandwich.

26 previous convictions

El Hadji Bamba gets carried away, threatens him with his handgun bought shortly before on Snapchat. “Make me the sandwich or I’ll kill you,” he says. Then he shoots three times. Two 9mm bullets lodged in the victim’s body, one of which in the lungs. The employee dies on the spot.

Prosecuted for murder, the accused already has 26 convictions on his criminal record. Violence, driving without a licence, theft, death threats, possession of narcotics… El Hadji Bamba, imprisoned since the incident, has already made five stays in prison, the first when he was a minor.

“Someone who is aware of their violence problem is someone who can be helped. Someone who denies this problem, who blames it on others, is a repeat offender, ”said the Advocate General in her indictment.
